Liability Waiver

This Liability Waiver and Release of Claims ("Agreement") is entered into between the undersigned participant (or parent/legal guardian if participant is a minor under the age of 18) and Diamond Lab LLC, located at 21730 Lassen St, Chatsworth, CA ("Diamond Lab").
Diamond Lab provides baseball and softball training services including but not limited to: batting cage use, pitching simulator operation, HitTrax launch tracking system use, high-speed video analysis, Trackman pitching analytics, live batting practice, pitching mound use, and all other activities conducted at or associated with the Diamond Lab facility.
I understand and acknowledge that participation in baseball and softball training activities involves inherent risks of injury, including but not limited to: being struck by a baseball or softball, collision with equipment or facility structures, muscle strains, sprains, fractures, and other physical injuries. These risks exist even when proper safety precautions are followed.
I voluntarily assume all risks associated with participation in Diamond Lab activities, whether known or unknown, and whether caused by the negligence of Diamond Lab, its owners, employees, agents, or otherwise.
In consideration of being permitted to participate in Diamond Lab activities, I hereby release, waive, discharge, and covenant not to sue Diamond Lab LLC, its owners, members, managers, employees, agents, representatives, successors, and assigns from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by the participant, whether caused by the negligence of Diamond Lab or otherwise, while participating in any activity at or associated with the Diamond Lab facility.
I agree to indemnify and hold harmless Diamond Lab LLC and its owners, members, managers, employees, and agents from any loss, liability, damage, or costs, including court costs and attorneys' fees, that may be incurred due to participation in Diamond Lab activities, whether caused by the negligence of Diamond Lab or otherwise.
In the event of an emergency, I authorize Diamond Lab staff to seek medical attention for the participant if necessary. I acknowledge that Diamond Lab is not responsible for any medical expenses incurred.
I agree to follow all Diamond Lab facility rules and staff instructions at all times. I understand that failure to comply may result in immediate removal from the facility without refund. I agree not to use the facility or equipment while under the influence of alcohol or drugs.
If the participant grants the photo and video release below, Diamond Lab LLC is hereby authorized to capture, use, and publish photographs, video recordings, and other media featuring the participant taken at or associated with the Diamond Lab facility. Such media may be used for marketing, promotional, social media, and educational purposes without compensation to the participant.
This Agreement shall be governed by the laws of the State of California. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
I have read this Agreement in its entirety, I understand its terms, and I am signing it freely and voluntarily. I am 15 years of age or older, or I am the parent/legal guardian of the minor participant named below and have the authority to execute this Agreement on their behalf.
